Terms of use

1. Who we are and what you accept

RackMates is an application by David Mañas (“RackMates”, “we”). By creating an account you accept these terms and the privacy policy. If you disagree with anything, do not use RackMates. When we change the terms we will ask you to accept the new version inside the app; the version number appears above.

2. What RackMates is

RackMates connects people who train at the same gym, box or spot: it shows how many RackMates people checked in at a place, lets you say when you are going, create plans, chat, follow your circle and log workouts. RackMates is not a gym, does not organise training or sports activities, does not sell training sessions and does not provide health services.

3. Your account

  • You must be 16 or older.
  • You need an email (or an Apple or Google account) and, to create open plans, join them or message someone, a verified email (we send you a 6-digit code). One account per person.
  • The account is personal. You are responsible for what is done with it and for keeping your password safe. If you think someone else is using it, change the password from Me → Account or write to us.
  • You can delete your account at any time from Me → Privacy → Delete account.

4. Rules of use

RackMates is for training together. The following is not allowed:

  • Checking in at a place where you are not, or tampering with presence, location or how the app works.
  • Harassing, threatening, insulting, discriminating against or making unwanted sexual comments to anyone, inside or outside the app, in relation to what happens in it.
  • Impersonating another person, a gym or a trainer, or creating fake or multiple accounts.
  • Using RackMates to sell or promote products or services (except what the trainer profile allows, section 6), sending spam or collecting other people’s data.
  • Posting illegal, violent or sexual content, or content that infringes third-party rights.
  • Encouraging practices dangerous to health (for example doping or eating disorders).
  • Accessing the app by automated means, reverse engineering it or overloading the service.

The community rules expand on these points. If you break them we may warn you, remove content, limit features or close your account, depending on severity. Every report is reviewed by a person within 24 hours and you can always reply by writing to [email protected].

5. Your content

What you post (photo, bio, plans, messages, routines) is yours. You grant us a non-exclusive, free licence limited to showing it on RackMates to the people it is addressed to, for as long as you keep it posted. When you delete it or delete your account, the licence ends, except for backups that are removed within 30 days and whatever the law obliges us to keep.

You are responsible for having the right to post what you post.

6. Groups, trainers and gyms

  • Groups: whoever creates a group administers it and is responsible for its rules within these terms. An empty group is deleted.
  • Trainers: anyone with a verified email can enable a trainer profile (specialties, description, indicative price, gyms). It is only a showcase and a contact channel: RackMates does not intervene in the relationship, does not charge or manage sessions, does not verify qualifications and is not responsible for the service provided. Reviews are the opinions of whoever writes them; only people who share a gym with the trainer can review.
  • Gyms: gym pages are created from public data (name, address) and what the people training there add. A gym can claim its page from the app to edit hours, website and phone, or ask us to remove it by writing to [email protected]. Claiming a page gives no access to people’s data.

7. Plans, presence and safety

  • A plan is a proposal between private individuals. RackMates does not check who turns up and does not guarantee that a plan takes place. The “reliability” indicator only reflects your own attendance history for plans you joined.
  • The “inside now” number counts RackMates people who checked in. It is not the gym’s occupancy and must not be used as such.
  • Training carries risks. You decide whom you meet, what you do and whether you are fit to do it. If you have doubts about your health, consult a professional. Meeting someone for the first time in a busy public place, such as the gym floor, is always a good idea.

8. RackMates Pro and purchases

  • RackMates Pro costs €3.99 a month or €29.99 a year (subscriptions that renew automatically until you cancel them in the store). It is not on sale yet: these terms will apply once it is. It includes people filters in Discover, more than 3 open plans at once and admin of more than 1 group.
  • Boost 24 h costs €0.99 and is a one-off purchase: a credit to pin one of your plans at the top of your gym’s timeline for 24 hours. Credits do not expire.
  • Purchases are made with Apple (App Store) or Google (Google Play) using your store account and are also governed by their terms. The subscription renews unless you cancel it at least 24 hours before the end of the period, from your store account settings. Refunds are handled by the store under its policy.
  • Prices include VAT and may change; we will tell you about any change before it applies to your renewal.
  • If you cancel, you stay Pro until the end of the paid period and then return to the free version without losing your data.
  • Right of withdrawal: for digital purchases that start immediately you may lose the 14-day withdrawal right once performance begins with your consent; the store will tell you when you buy.

9. Availability and changes to the service

We work to keep RackMates running, but we cannot guarantee it will be available without interruptions or errors. We may change, add or remove features. If we shut RackMates down, we would give you at least 30 days’ notice so you can download your data.

10. Liability

To the extent the law allows, RackMates is not liable for:

  • what other members of the community do, inside or outside the app;
  • damage arising from training, attending a plan or the relationship with a trainer or a gym;
  • the accuracy of gym, plan or presence information;
  • service interruptions, data loss for reasons beyond our control or failures of third parties (stores, providers).

None of the above limits liability that the law does not allow to be limited, nor your rights as a consumer. If we are liable for something, our liability is limited, where the law allows, to the amount you paid us in the previous 12 months.

11. Intellectual property

RackMates, its brand, design and code belong to us or our licensors. We grant you a personal, revocable, non-exclusive licence to use the app under these terms. You acquire no other rights.

12. Law and jurisdiction

These terms are governed by Spanish law. Any dispute will be heard by the courts of the consumer’s domicile in Spain. If you live in the European Union, you keep the protection of the mandatory rules of your country. You can also use the European online dispute resolution platform (ec.europa.eu/consumers/odr).
